Securing a Bond Hearing When Immigration Court Won't Grant One

In many cases, the immigration judge has either refused to hold a bond hearing or has declared that they have no jurisdiction to grant bond. This is one situation where a habeas corpus petition may be appropriate. When immigration court remedies are unavailable or have been exhausted, a federal judge may, in appropriate circumstances, order further review or a custody hearing.

In some successful cases, courts order a custody hearing within a specified timeframe. At that hearing, the court will determine whether continued detention is justified, which may include evaluating danger or flight risk. We will prepare your loved one's case for that hearing and advocate aggressively for their release.

Challenging Prolonged or Indefinite ICE Detention

Under the Supreme Court's landmark decision in Zadvydas v. Davis (2001), the Supreme Court has held that, after a presumptively reasonable six-month period following a final removal order, continued detention may be challenged if removal is not reasonably foreseeable. If your loved one has been in detention for an extended period, especially past six months, and there is no clear or imminent removal order being carried out, we can file a habeas petition arguing that continued detention violates their constitutional rights.

This applies in situations where:

• Removal has been ordered but cannot be carried out (for example, because a country will not accept deportees)
• Your loved one has been granted withholding of removal but ICE continues to hold them
• Detention has stretched on for months while removal proceedings remain unresolved

Preventing ICE Transfers to Out-of-State Facilities

One of the most urgent reasons to contact us immediately is that ICE has a documented practice of rapidly transferring detained individuals from California to facilities in Texas or Louisiana. And, some courts, including those in the Fifth Circuit, have taken more restrictive approaches in certain detention cases.

California, by contrast, falls within the Ninth Circuit, which has a more established body of law protecting detained immigrants' rights to bond hearings and judicial review. Filing may, in some cases, affect how a transfer is handled, but does not guarantee that a transfer will be prevented.

Habeas Relief for Lawful Permanent Residents & Long-Term Residents

Habeas corpus is not just for recent arrivals. Long-term residents, lawful permanent residents (Green Card holders), and individuals with deep ties to the United States have also found themselves detained, sometimes based on old convictions or circumstances they believed had been resolved years ago. If a prior criminal conviction that triggered immigration consequences has since been vacated or dismissed—including through post-conviction relief—and ICE continues to hold your loved one despite the vacated conviction, we can challenge the detention through the habeas process. A federal court may order release if it determines there is no lawful basis for continued detention.

Challenging Unconstitutional Conditions of Confinement

In limited and evolving areas of law, some courts have allowed habeas or related federal actions to address certain conditions of confinement. If your loved one is being subjected to treatment that raises serious constitutional concerns, we can evaluate whether a habeas petition or related federal court action is appropriate.

What Happens If the Habeas Petition Is Granted?

We want you to have realistic expectations going in. Winning a habeas petition does not automatically mean the removal case goes away. The underlying immigration proceedings continue regardless. What a successful petition does is address the detention itself.

The three most common outcomes when a federal court grants a habeas petition are:

1. A bond hearing ordered before an immigration judge. This is the most frequent result. The court rules that your loved one is entitled to an individualized custody determination, and the government must provide that hearing, typically within 7 to 21 days. At that hearing, you can argue for release on bond.
2. Immediate release ordered by the court. In some cases, courts have ordered release where the legal basis for detention no longer exists.
3. Release subject to conditions. Some judges order release with conditions such as GPS monitoring through ICE's Alternatives to Detention program. This is still freedom; your loved one comes home while the immigration case continues.
